Rules and Regulations

At the July 11, 2006 regular monthly meeting of the Board of Directors of The Preserve Homeowners’ Association, Inc., the Board unanimously adopted the following rule applicable to all properties within The Preserve pursuant to its authority under Article III, Section 5(a)(6) of the Association’s By-Laws:

No new home shall be built in The Preserve with less than 2000 square feet of heated living space, exclusive of the basement, so as not to be smaller than any currently existing home located within The Preserve, and all homes constructed within The Preserve shall be two story colonial and/or transitional style homes consistent in style and appearance with those homes which already exist within The Preserve.

This rule was effective upon its adoption by the Board on July 11, 2006.

Covenants & Bylaws

2) The purchase of a residential unit on one of the homesites in the Preserve Development includes the cost of your membership in the Preserve Homeowners’ Association (HOA). See the Declaration of Covenants,

3) Conditions and Restrictions for The Preserve that was filed in the Onondaga County Courthouse on March 22, 1994.

4) The annual assessment (dues) for the year of 2023 is $300.

5) The following link is a copy of the current budget and/ or proposed budget for the following year.

6) The attached pdf is a copy of the most recent financial statements for the operations of the HOA.

7) The attached pdf also includes a MEMORANDUM dated November 21, 1997 that summarizes the important operational aspects of the Homeowners’ Association.

8) Also included is a copy of the by-laws of the Homeowners’ Association that were adopted on October 21, 1993 by the then current Board of Directors of the HOA.

View Preserve HOA Covenants

Declaration of Convenants, Conditions & Restrictions for The Preserve & Bylaws of The Preserve Homeowners’ Association Inc.

Each property in the Preserve is owned subject to the Declaration of Covenants, Conditions and Restrictions, which is available here [here].  The Declaration of Covenants is a legally binding document that imposes certain important restrictions on all owners, including but not limited to the following:

  • Requires that any modification to the residential unit, other building, fence, wall or other structure be approved by the Board of Directors. (Section 2.04).  This process is explained in more detail here [hyperlink]
  • Requires that owners maintain their property and keep it in good condition and repair. (Section 2.04)
  • Allows owners use of the common areas of the Preserve as provided by the Board. (Section 2.05)
  • Provides that “[n]o animals, livestock, or poultry of any kind shall be raised, bred, or kept on the Properties, except that no more than a total of two (2) dogs, cats, or other normal household pets may be kept in residences subject to rules and regulations adopted by the Association through its Board of Directors . . . .” (Section 2.10)
  • Prohibits any fences or walls except on the rear lot line, and requires that any fences on the rear lot line be approved by the Board. (Section 2.11)  Note that governmental requirements of a fence around pools supersede this rule, and the Board will consider and, if appropriate, approve fences around pools while cognizant of the Covenants.
  • Requires owners to pay any assessments levied by the Board of Directors (Section 9.01). Generally, this is done through a single yearly dues payment in the early spring.

In addition, the Covenants requires and authorizes the creation of a Board of Directors to effectuate the Covenants, and authorizes the Board to create Bylaws.  The Bylaws are available here [hyperlink].  Generally, the By-laws provide the rules by which the Association governs itself.  It empowers the Board of Directors to take certain actions on behalf of the Association, while reserving certain rights to the entire Association (of which each property owner is a member).  Generally, consistently with the By-Laws, the Association holds an annual meeting each September to address any item requiring action of the entire membership.
