The Board of Directors of the Association has exclusive jurisdiction over modifications, additions and alterations made on or to all homes and lots within The Preserve, in accordance with the Declaration of Covenants, Conditions and Restrictions for The Preserve recorded on March 22, 1994 with the Onondaga County Clerk’s office, and as thereafter amended.

Pursuant to the Declaration of Covenants, no residential unit (as that term is defined in the covenants), additional building, fence, wall or other structure on any lot may be altered or added to in any way which materially affects the exterior appearance thereof unless and until plans and specifications showing the nature, kind, shape, height, materials, colors and locations of the same have been approved by the Board of Directors.

A courtesy check with your neighbors should be discussed along with respecting a 5 foot encroachment to a neighbors property as well as getting approval from the town of Pompey.

If you have any doubt as to whether an approval is required for a particular project, please consult the Declaration of Covenants, or contact a member of the Board of Directors.

Modifications, additions or alterations undertaken without prior approval by the Board of Directors are subject to removal, at the homeowner’s expense.

The Approval Process is as Follows:

  1. An application for any approval required by the Covenants shall be submitted, in writing and with all of the information required by the Covenants, to the Board of Directors. Please use the Application form below for all such applications, and provide all information requested on that form.
  2. The Vice-President of the Board serves as the Chairperson of the Architecture Committee. Applications may either be delivered personally to the Vice-President of the Board, or mailed to the Board at the following address:

  3. Upon receipt of an application, the application and all supporting documents will be distributed to the members of the Board for review. If further information is deemed necessary in order for a determination to be made by the Board, the applicant will be contacted for such information. A site visit may also be requested, depending upon the nature of the application.
  4. The Board of Directors will act upon the application at its next regularly scheduled meeting, and, if the application materials are deemed to be complete, will either approve or deny the application, in writing, in accordance with the Declaration of Covenants, Conditions and Restrictions for The Preserve.
  5. If an application is denied, or if an application is granted subject to conditions with which the applicant does not agree, the applicant may appeal the decision by submitting a written appeal to the Board of Directors, setting forth the basis of the appeal, within thirty (30) days of the date of the notice of denial, or of approval with conditions, and by appearing thereafter at the next regularly scheduled meeting of the Board.

Please be mindful that the members of the Board of Directors are volunteers who typically do not meet more frequently than monthly, and that the Board has sixty (60) days within which to approve or deny an application. Therefore, applicants should submit applications for approval significantly in advance of any planned date for the commencement of any work. Any work undertaken prior to receipt of a written approval from the Board of Directors is undertaken at the sole risk and peril of the homeowner undertaking such work.
